Regulation Status

• Wisconsin regulates AI through targeted statutes rather than a comprehensive AI act, addressing political advertising, child sexual abuse material, and real estate advertising. 2023 Wisconsin Act 123, codified at Wis. Stat. section 11.1303, requires political advertisements containing express advocacy or issue advocacy, or supporting or opposing a referendum, that incorporate audio or video substantially produced in whole or in part by generative AI to carry a disclaimer indicating that the content was created with generative AI, subject to a $1,000 penalty per violation.
• Wisconsin has criminalized AI-generated child sexual abuse material through an amendment to its CSAM statute, which criminalizes possession of a computer-generated depiction of a purported child as a Class D felony, making Wisconsin one of the states with a statute reaching virtual CSAM.
• The Advertising Enhanced by Technology provision, Wis. Stat. section 452.136(1m), requires licensed real estate professionals to disclose when a real estate advertisement has been altered or modified using technology, including AI, to add, remove, or change elements of a property in a way that creates a false or misleading impression, enforced by suspension or revocation of the real estate license and penalties up to $5,000 per violation.
