Regulation Status

• Oklahoma regulates AI through targeted statutes rather than a single omnibus law, concentrating on synthetic sexual content, education, and data privacy. HB 3642 extended the state's child-sexual-abuse-material offenses to artificially generated content, with existing criminal penalties applying.
• Oklahoma’s nonconsensual-intimate-images law, Section 1040.13b, covers artificially generated sexual depictions of another person disseminated without that person’s consent and with intent, or reckless disregard, to harass, annoy, threaten, alarm, or cause physical, emotional, reputational, or economic harm; violations are misdemeanors punishable by a fine of up to $1,000.
• The Oklahoma Responsible Technology in Schools Act (SB 1734) regulates AI use in public schools, requiring educator-directed, human-in-the-loop AI that is age-appropriate and tied to a defined educational purpose, barring AI as the primary basis for grading, promotion, or discipline, mandating student-data minimization and annual parental disclosure, and requiring district AI and emerging-technology policies.
• On data-driven automated decisions, the Oklahoma Consumer Data Privacy Act (SB 546) gives consumers a right to opt out of solely automated processing of personal data used to evaluate or predict personal aspects in furtherance of decisions producing legal or similarly significant effects, with Attorney General enforcement and penalties up to $7,500 per violation. Oklahoma has not enacted a broad, risk-based AI framework.
• Executive and agency developments: Executive Order 2023-24: Emerging Technologies Task Force: Creates a task force through December 31, 2023 to recommend responsible AI and generative-AI policies, governance, data management, and model oversight. Directs agencies to identify an employee to develop AI expertise and submit that person's name by November 1, 2023.
