Regulation Status

• New Mexico has not adopted a comprehensive AI statute; its enacted AI regulation is limited to synthetic media in elections through an amendment to the New Mexico Campaign Reporting Act addressing AI-generated deepfakes in political advertising.
• The amendment requires any person who creates, produces, or purchases a political advertisement containing an AI-generated deepfake to include a clear and conspicuous disclaimer that the media has been manipulated or generated by artificial intelligence.
• Enforcement includes civil penalties of up to $1,000 per violation, capped at $20,000 total, with criminal exposure including a misdemeanor for a first conviction and a fourth-degree felony for a second conviction.
• As of 2026 New Mexico continues to rely on generally applicable consumer-protection, privacy, and civil-rights law for other AI harms, leaving the deepfake disclosure requirement as the state's principal AI-specific law.
