Regulation Status

• Nevada moved aggressively on AI in health, education, and consumer-facing chatbots in its 2025 session. AB 406, signed by Governor Lombardo on 5 June 2025 (Chapter 283) and effective 1 July 2025, amended NRS chapters 629, 391, and 433 to prohibit mental- and behavioral-health providers from using AI systems in direct patient care while permitting administrative-support uses, to bar public schools from using AI to perform the functions of school counselors, psychologists, or social workers and require the Department of Education to adopt a governing policy, and to prohibit AI providers from offering systems that constitute the practice of professional mental or behavioral health care or from representing that an AI system can provide such care, backed by civil penalties of up to $15,000 and professional discipline.
• Nevada also regulates synthetic media in elections: its AI political-advertising law, codified in NRS Chapter 294A.347-95 and effective 1 January 2026, requires any political campaign communication containing AI-manipulated synthetic media to carry a disclosure stating "This (image/video/audio) has been manipulated," with injured parties able to seek injunctive or equitable relief in district court.
• Nevada has not enacted a comprehensive frontier-model or algorithmic-discrimination act; its 2025 posture is distinctive for one of the nation's strictest bans on AI in mental and behavioral health care and school counseling, complemented by election synthetic-media disclosure rules.
