Regulation Status
- Michigan has not enacted a comprehensive or risk-based AI statute and has focused its AI-specific lawmaking on election integrity. In November 2023 the legislature passed a package (Public Acts 263-266 of 2023) amending the Michigan Campaign Finance Act and Michigan Election Law; the two AI-focused measures, HB 5141 (PA 263) and HB 5144 (PA 265), both took effect on February 13, 2024.
- HB 5141 requires political advertisements generated in whole or substantially by AI, including those communicated by phone, radio, or print, to carry a clear disclaimer; the source data does not specify an enforcement mechanism. HB 5144 prohibits distributing materially deceptive AI-generated media within 90 days of an election where the distributor intends to harm a candidate or change voter behavior, unless an appropriate disclaimer is provided; penalties for the deepfake offense include imprisonment, injunctive relief, and fines up to $1,000. Michigan has not enacted deepfake-in-intimate-imagery, automated-decision, or frontier-model AI legislation as of mid-2026, and it has no omnibus AI governance framework for state agencies.
