Regulation Status

  • Massachusetts has not enacted a comprehensive or omnibus AI statute; its AI regulation to date is confined to synthetic-media abuse. In 2024 the Legislature passed "An Act to Prevent Abuse and Exploitation" (HB 4744, Chapter 118 of the Acts of 2024), signed by Governor Maura Healey, which for the first time criminalized non-consensual dissemination of intimate images ("revenge porn") in the Commonwealth and extended that prohibition to AI-generated and digitally altered depictions.
  • The law amends the intimate-images statute to cover "material produced by digitization" and the creation or alteration of visual material through computer-generated images that would falsely appear to a reasonable person to be an authentic representation of the depicted person, thereby reaching deepfake pornography of identifiable individuals even where no real photograph exists. Existing criminal penalties apply, and consent to creation of such material is expressly not treated as consent to its distribution.
  • Beyond this deepfake-focused amendment, Massachusetts continues to rely on general consumer-protection, privacy, and civil-rights law rather than AI-specific rules; the Attorney General has issued advisories signaling that existing statutes apply to AI, but as of 2026 no broad AI-governance or automated-decision statute has been enacted.
