Regulation Status

• Maryland is a moderately high-volume state on AI regulation, legislating through a series of targeted statutes rather than a single comprehensive AI act. Its earliest measures amended the state CSAM statute (Md. Code, Crim. Law 11-208) to cover computer-generated images indistinguishable from an identifiable child under 16, and enacted the Maryland AI Governance Act of 2024 (SB 818), which requires state government units to inventory and annually assess high-risk AI systems and directs the Department of Information Technology to set governing policies.
• Maryland regulates automated processing and AI in insurance through the Maryland Online Data Privacy Act (Md. Code Ann. 14-4601 et seq.), which grants an opt-out of solely automated profiling in furtherance of significant decisions and requires data protection assessments in certain circumstances, and through AI utilization-review provisions (Md. Code Ann., Ins. 15-10A-06, 15-10B-05.1), which constrain carriers’ use of AI in utilization review, require quarterly adverse-decision reporting to the Insurance Commissioner, and preserve provider roles in adverse-decision procedures. Maryland also enacted HB 1563, extending adverse-decision reporting for emergency-room services and post-acute-care coverage to include whether AI was used.
• Maryland also advanced consumer-, education-, election-, and deepfake-focused AI laws: SB 141 targeting election deepfakes and misinformation; the Artificial Intelligence Ready Schools Act (SB 720) directing state education guidance and local AI policies; the Protection from Predatory Pricing Act (HB 895) restricting personalized and dynamic pricing in the food sector; and SB 8 prohibiting harmful AI or deepfake impersonation and false-record conduct while allowing victim civil actions.
