Regulation Status

  • Maine regulates AI through consumer-protection and professional-licensing statutes rather than a comprehensive framework. LD 1727 (HP 1154), An Act to Ensure Transparency in Consumer Transactions Involving Artificial Intelligence, enacted a new chapter 239 of Title 10 (10 MRSA c. 239), effective 24 September 2025, requiring clear and conspicuous disclosure when any person uses an AI chatbot or other computer technology in trade and commerce in a way that could mislead or deceive a reasonable consumer into believing they are dealing with a human.
  • Maine also acted on AI in mental health care. HP 1397 (LD 2082), effective 14 July 2026, regulates the use of AI by licensed psychotherapy and behavioral-health professionals, permitting only administrative and supplementary AI support under full professional responsibility, requiring written notice and client consent for AI-recorded or transcribed sessions, and prohibiting anyone from advertising or offering internet-based AI therapy unless the services are delivered by a licensed professional who prevents independent AI therapeutic decisions and reviews and approves AI-generated recommendations or treatment plans, with a narrow exception for approved research or federally authorized interventions.
  • Both statutes are enforced through the Maine Unfair Trade Practices Act, and the therapy law additionally exposes violators to disciplinary action by the relevant licensing board. Maine has not enacted a broad, risk-based AI statute governing high-risk automated decision systems generally.
