Regulation Status

• Louisiana has not enacted a comprehensive AI statute but has layered AI-specific provisions onto its criminal, privacy, education, and child-protection laws. Its synthetic sexual media laws include the Louisiana Deepfake Law (R.S. 14:73.13), which criminalizes specified distribution or sale of non-consensual sexual deepfakes of adults and creation or possession of sexual or nude deepfake depictions of minors, and the AI Intimate Image Law (R.S. 14:73.14), which criminalizes malicious dissemination or sale of unauthorized AI-created intimate imagery.
• Louisiana continued this trajectory through child-protection and education measures. SB 110 prohibits using a child’s image to train an AI model to produce child sexual abuse material and extends the CSAM definition to digitally generated, visually indistinguishable depictions of children under 17. SB 347 amends the Campus Accountability and Safety Act to classify AI and deepfake sexual imagery as “power-based violence” on college campuses.
• Louisiana has enacted the Louisiana Data Privacy Act (SB 386), granting consumers a right to opt out of solely automated processing used to evaluate, analyze, or predict personal aspects in furtherance of decisions producing legal or similarly significant effects, and requiring data-protection assessments of each such processing activity.
