Regulation Status
- Idaho has legislated on AI incrementally, beginning with I.C. § 5-346, which prohibits granting legal personhood to artificial intelligence in the state without specifying a penalty, and continuing with an explicit-synthetic-media law (Idaho Code § 18-6606) criminalizing the knowing disclosure of AI-generated intimate imagery that realistically misrepresents an identifiable individual, punishable by misdemeanor or felony charges and up to $25,000 in criminal fines.
- Idaho enacted S1227, which directs the State Department of Education to develop a statewide AI-in-education framework for K-12 public schools, including human-centered oversight, integration guidance, and accessibility, and requires local districts and charter schools to adopt policies governing student and employee use of generative AI and to obtain vendor disclosures on machine learning, predictive analytics, and generative AI, with data-protection and algorithmic-transparency assurances.
- Idaho also passed S1297, the Conversational AI Safety Act, which requires operators of public conversational AI services to disclose AI interactions, adopt suicide-ideation response protocols, avoid representing the service as professional mental or behavioral health care, and apply heightened safeguards for minor users, subject to injunctive relief and liability of $1,000 per violation up to $500,000 per operator or actual damages, whichever is greater.
- Idaho has not adopted a comprehensive AI or algorithmic-discrimination statute; its framework targets synthetic-media harms, AI use in schools, and consumer-facing chatbot safety, alongside its early personhood prohibition.
