Regulation Status
- Delaware has not enacted a comprehensive AI statute but has adopted a series of targeted measures spanning government use, synthetic sexual imagery, consumer privacy, and health-care titles. Its government-facing Delaware Artificial Intelligence Commission Act (HB 233) requires the Delaware Artificial Intelligence Commission to inventory all generative-AI usage across Delaware state government, with no specified penalty.
- On synthetic media, HB 353 amended the Delaware Code to set out civil and criminal remedies for the wrongful disclosure of deepfakes depicting identifiable, non-consenting individuals in the nude or engaging in sexual conduct, with the state's existing Unauthorized Disclosure of Intimate Images penalties applying. The Delaware Personal Data Privacy Act (Del. Code tit. 6, § 12D-101 et seq.) gives consumers a right to opt out of profiling in furtherance of solely automated decisions with legal or similarly significant effects and requires data protection assessments, enforced at up to $10,000 per violation.
- HB 191 bars artificial intelligence or any nonhuman entity from being licensed to practice nursing or medicine or certified as a physician assistant, and prohibits such entities from using or holding medical titles such as Dr., RN, or PA, with existing penalties for improper use of medical titles and credentials applying. Delaware has no omnibus developer or deployer risk-classification framework of the Colorado type.
