Regulation Status

• Peru has enacted a binding AI regime: Law No. 31814 (promoting the use of AI for economic and social development) classifies AI systems by risk level, prohibits unacceptable-risk uses, and requires lifecycle security measures including risk management, backup systems, algorithmic audits and incident reporting.
• Peru therefore has a comprehensive, binding AI-specific law in force, anchored by Law No. 31814 and its 2025 implementing regulation.
• The framework was operationalised by Supreme Decree No. 115-2025-PCM, the full implementing regulation approved by the Presidency of the Council of Ministers, comprising 6 titles, 36 articles and 6 final provisions with a risk-based classification, differentiated obligations for high-risk systems, and prohibitions on uses affecting fundamental rights, following consultations on successive drafts (2024-2025).
• These build on Peru's earlier digital-trust background, including Emergency Decree No. 007-2020 approving the Digital Trust Framework and the draft National AI Strategy (2021-2026), with Peru also signing the regional Cartagena Declaration (2024) and the APEC 2025 Digital and AI Ministerial Statement.
