Regulation Status

• As an EU member state, the Netherlands applies the EU AI Act and is building national oversight: the Cabinet launched a consultation in April 2026 on an AI Regulation Implementation Act to establish national supervision, and is pursuing a sector-by-sector enforcement approach prioritising prohibited practices then high-risk systems.
• The Netherlands is active internationally, co-proposing the 2024 UN resolution on military AI with South Korea, joining the 2025 data governance joint statement, and leading the Semicon Coalition's Chips Act 2.0 push; it has no separate national AI statute beyond EU AI Act implementation.
• The Dutch Data Protection Authority (AP) is highly active, issuing successive AI and Algorithmic Risks Reports, guidance on facial recognition, data scraping, emotion AI, manipulative AI and the right to explanation, and running consultations to interpret the AI Act's prohibitions.
• The AP has taken enforcement action, fining Clearview AI EUR 30.5 million in 2024 for unlawful facial-recognition data collection, and has warned against tools such as DeepSeek and autonomous AI agents; DeepSeek was also banned from civil servants' computers.
