Regulation Status

• Italy enacted a comprehensive national AI law (Senate Act No. 1146-B), in force from October 2025 and described as the first in the EU, which sits alongside the EU AI Act and includes prison terms of one to five years for harmful dissemination of AI-generated or manipulated content and harsher penalties for AI-enabled crimes.
• Italy's data protection authority (the Garante) has been one of Europe's most active AI enforcers, fining OpenAI EUR 15 million (2024), Replika's developer EUR 5 million (2025), and Character.AI EUR 158,000 (2026) over child privacy and age-verification failures, blocking DeepSeek (2025), restricting the ClothOff deepfake-nude app, and issuing guidance on web scraping and warnings on deepfake services such as Grok and ChatGPT.
• The competition authority (AGCM) has investigated Meta's integration of Meta AI in WhatsApp and concluded a case against the NOVA chatbot over undisclosed hallucination risks, while communications regulator AGCOM asked the European Commission to assess Google's AI services under the Digital Services Act.
• Italy designated AgID (Agency for Digital Italy) and the National Cybersecurity Agency (ACN) as the national authorities for the EU AI Act and earmarked an AI investment fund of around EUR 1 billion.
